These Terms of Service (“Terms”) govern your access to and use of the website at balantium.systems (the “Site”) operated by Balantium Systems LLC (“Balantium,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who we are
Balantium Systems LLC develops and licenses deterministic software platforms, including Data Forge, Cybersecurity Fortress, GraniteForge, and related modular products. The Site is for information, evaluation inquiries, and published pricing — not a self-service software download store.
2. No license from browsing the Site
Content on the Site (text, visuals, decks, video, documentation excerpts, and pricing summaries) is marketing and educational material only. Nothing on the Site grants you a license to use, copy, reverse engineer, or redistribute Balantium software, source code, or proprietary methods. Software use requires a separate executed license agreement, order form, and delivery of sealed binaries where applicable.
3. Acceptable use
You agree not to:
- Use the Site in violation of applicable law or third-party rights.
- Attempt unauthorized access to our systems, admin routes, or non-public APIs.
- Scrape, crawl, or harvest the Site at scale without written permission.
- Introduce malware, probe for vulnerabilities, or interfere with Site operation.
- Misrepresent affiliation with Balantium or imply endorsement without consent.
- Use contact forms to send spam, threats, or unlawful content.
We may suspend access, block requests, or cooperate with authorities when we believe misuse has occurred.
4. Intellectual property
Balantium and its licensors own all rights in the Site, trademarks, logos, product names, decks, video, and underlying software. You may view and share public URLs to the Site for legitimate business evaluation. You may not republish Site assets as your own product, remove proprietary notices, or use Balantium marks in a way that suggests partnership without written approval.
5. Contact and commercial terms
Submitting a contact or evaluation request does not create a contract. Commercial terms — including evaluation scope, fees, deliverables, confidentiality, and license scope — are defined only in signed documents (e.g., order form, master license agreement, statement of work). If there is a conflict between the Site and a signed agreement, the signed agreement controls.
6. Third-party links and payment processors
The Site may link to third parties (e.g., SSRN, payment processors such as Paddle). We are not responsible for third-party sites or their policies. When you pay through a processor, that processor’s terms may also apply to the transaction.
7. Disclaimers
The Site and its content are provided “as is” and “as available.” We do not warrant uninterrupted access, error-free content, or that published materials are complete for every buyer scenario. Performance claims on the Site are tied to documented methodology and stated scope; they are not guarantees of future results on your data until validated under your agreement.
8. Limitation of liability
To the maximum extent permitted by law, Balantium and its officers, members, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunity arising from your use of the Site. Our aggregate liability for Site-related claims is limited to one hundred U.S. dollars (USD $100) or the amount you paid us solely for Site-related services in the twelve months before the claim — whichever is greater — except where liability cannot be limited by law.
9. Indemnity
You agree to indemnify and hold Balantium harmless from claims arising out of your misuse of the Site, violation of these Terms, or infringement of third-party rights where caused by your conduct.
10. Changes
We may update these Terms by posting a revised version on the Site with a new effective date. Continued use after changes constitutes acceptance. Material changes to commercial policies may also be reflected in our Refund Policy and Privacy Policy.
11. Governing law
These Terms are governed by the laws of the United States and the state in which Balantium Systems LLC is organized, without regard to conflict-of-law rules. Exclusive venue for disputes relating to the Site (not licensed software disputes covered by a separate agreement) lies in courts located in that state, unless applicable law requires otherwise.
